Toute réservation du client entraîne l'entière adhésion aux présentes conditions générales de ventes sauf conditions particulières consenties par écrit entre la photographe et le client. Les présentes conditions générales de vente forment un document contractuel indivisible avec le contrat de vente.
1. Réservation
Toute réservation passée par le client fait l'objet d'une confirmation par mail accompagnée d’un acompte d’un montant fixé par la photographe en rapport à la prestation demandée. La réservation prend effet le jour de la réception de ce paiement qui vaudra dès lors pour réservation définitive. À défaut du paiement de cet acompte, la réservation n'est pas prise en compte.
2. Tarifs
La photographe se réserve le droit de modifier ses tarifs et prestations à tout moment sans préavis ni indemnité pour répercuter une éventuelle et imprévue hausse de tarifs des fournisseurs de produits photographiques, ou d’un changement entraînant un rallongement de la prestation. Le solde est à régler le jour de la séance. Les paiements par espèces et virements bancaires via les plateformes Lydia et Paypal sont privilégiés. La photographe délivrera une facture par mail après la séance photo et s’engage à confirmer auprès du client la bonne réception du paiement.
3. Report & Rétraction
Le client peut se rétracter à tout moment au moins 10 jours précédant le rendez-vous, si ce délai est dépassé, l’acompte versé ne sera pas remboursé. Le client peut aussi reporter la date du rendez-vous dans ce même délai avec les mêmes conditions sauf cas de force majeure (intempéries, maladies, etc). Une telle annulation ne pourra donner lieu à un versement de dommages et intérêts à quelques titres que ce soit. Si l’acte est répété à plusieurs reprises, de manière excessive et sans justification valable, la photographe se laisse le droit de refuser de servir le client à l’avenir. En cas de conditions climatiques défavorables la photographe ne pourra être tenu responsable de la non-exécution ou de l'exécution partielle de la prestation initialement prévue à la commande lorsque ces prises de vue doivent être réalisées en extérieur ou lorsque l'accès au studio ou au domicile du client s'avérait impossible.
4. Déroulement de la séance photo
Le client s'engage à être à l'heure au rendez-vous fixé pour la séance. Au-delà de 15 minutes de retard sans justification valable (le trafic n’entre pas en compte) la photographe se réserve le droit de reporter la prestation ou d'appliquer une majoration sur le prix de séance de la prestation. Le temps de retard sera amputé sur le délai initialement prévu et ce pour ne pas pénaliser si un autre client suit car il n'a pas à subir le retard. Le client est autorisé à filmer ou photographier les backstages s’il le souhaite mais la photographe doit obligatoirement avoir un droit de regard et donner son autorisation pour y diffuser de quelques manières que ce soit. Il est autorisé de venir accompagner cependant il sera demandé à la tierce personne de ne pas gêner le travail de la photographe. Il est aussi possible de venir accompagner d’inspirations et d’objets divers si la demande du client est spécifique. Enfin, le client devra remplir et signer en deux exemplaires une autorisation de droit à l’image (si le client est mineur, une autorisation sera à demander en amont pour que le responsable légal puisse la remplir et la signer au cas où il serait absent le jour de la séance photo).
5. Post-production
L’editing et la post-production font partie intégrante du travail, du style et de l’univers artistique de la photographe au même titre que la prise de vue lui est propre. La photographe est seule juge du post-traitement final qu'elle applique sur l’ensemble des images. Cependant, une discussion avec le client se fera en amont pour des demandes spécifiques (camoufler certains détails par exemple). Pour une commande de livre photo, il est possible pour le client d’envoyer des mises en pages qui lui plaisent pour que la photographe s’en inspire.
Aucun fichier brut (RAW) ne sera livré au client et ne pourra être exigé. Les fichiers numériques sont livrés par email via WeTransfer au format JPEG. La photographe s’engage à conserver les fichiers numériques durant un an après la date de la prise de vue sauf catastrophe indépendante de sa volonté : au-delà, la sauvegarde des fichiers n'est plus assurée et ceux-ci peuvent être détruits.
6. Problème technique et/ou accident(s)
En cas de problème technique avec le matériel photographique ou d'un accident quelconque pendant la prestation et empêchant la photographe de remettre le travail demandé, l'intégralité du montant versé sera remboursée sans pour autant donner lieu au versement de dommages et intérêts à quelques titres que ce soit. Le client pourra également accepter le report de la séance à une date ultérieure. En cas de perte ou de détérioration les photos avant leur livraison ne permettant plus la réalisation complète de la prestation initialement prévu le client pourra prétendre remboursement de la prestation partiel au total.
7. Tirages
Le montant total des produits est à payer en intégralité le jour de la commande conformément à l'article 1-21 20 du Code de la Consommation, le droit de rétractation ne peut être exercé pour ces produits considéré comme étant nettement personnalisé. Le paiement s’effectuera par espèces ou virement bancaire / Paypal, et la livraison par voie postale* ou en main propre. Le délai de livraison de la commande se situe entre 15 et 20 jours à partir du paiement sauf cas exceptionnel (problèmes imprévus avec le fournisseur). La commande de tirages se réalise par mail ou sur Instagram. La demande doit être composée des informations suivantes : le nom des photos souhaitées (si hors shooting), la taille et le type de papier souhaité**, l'adresse postale.
*les délais supplémentaires entraînés par le service postal ne seront pas pris en compte par la photographe car ils sont indépendants de sa volonté.
**en cas d'indécision de la part du client, la photographe reste disponible pour aider à faire le bon choix. Les tailles et types de papier disponibles sont précisés dans la story à la une "Prints" sur le compte Instagram
8. Propriété intellectuelle
Les photographies réalisées sont des œuvres de l’esprit protégées par le Code de la Propriété Intellectuelle (Art. L111-1 et suivants). Même après la livraison des fichiers, la photographe demeure l'unique titulaire des droits de propriété intellectuelle. Seul le droit à l'image du client est inaliénable. Un quelconque usage commercial devra être précisé au moment de la réservation. Toute utilisation non autorisée (diffusion, reproduction) constitue un délit de contrefaçon au sens de l'article L335-2 du CPI, punissable de peines allant jusqu'à 3 ans d'emprisonnement et 300 000 € d'amende. Pour toute diffusion publique, le client doit obligatoirement citer la photographe : "© Chloé Oczkowski" et l'identifier via son compte correspondant. Le non-respect de cette mention pourra donner lieu à une facturation forfaitaire de 40 € par image diffusée. Lorsque le client achète les fichiers numériques en haute résolution il est autorisé d’enregistrer sur tous supports qu'il souhaite dans un seul but de conservation uniquement pour son usage personnel et privé.
9. Protection des données (RGPD)
Conformément au Règlement Général sur la Protection des Données (RGPD) et à la loi Informatique et Libertés, les informations collectées (nom, email, image) sont nécessaires au traitement de votre commande. Vous disposez d’un droit d’accès, de rectification et de suppression de vos données en contactant directement la photographe à l'adresse mentionnée à l'article 10.
10. Loi applicable et langue du contrat
Les présentes conditions sont régies par le droit français. Elles sont rédigées en langue française. Dans le cas où elles seraient traduites en une ou plusieurs langues étrangères, seul le texte français ferait foi en cas de litige.
General terms and conditions of sales

Any booking made by the client implies full acceptance of these General Terms and Conditions of Sale, unless specific conditions are agreed upon in writing between the photographer and the client. These General Terms and Conditions of Sale form an indivisible contractual document with the sales contract.
1. Booking
Every booking made by the client is confirmed by email and requires a deposit, the amount of which is determined by the photographer based on the requested service. The booking takes effect on the day this payment is received, which then constitutes a final reservation. In the absence of this deposit, the booking will not be processed.
2. Prices
The photographer reserves the right to modify her prices and services at any time, without notice or compensation, to reflect any unforeseen increase in costs from photographic suppliers or changes resulting in an extension of the service. The balance is due on the day of the session. Payments by cash and bank transfers via Lydia and Paypal platforms are preferred. The photographer will issue an invoice by email after the photo session and agrees to confirm the receipt of payment to the client.
3. Rescheduling & Cancellation
The client may cancel at any time at least 10 days before the appointment; if this deadline is exceeded, the deposit paid will not be refunded. The client may also reschedule the appointment within the same timeframe and under the same conditions, except in cases of force majeure (bad weather, illness, etc.). Such cancellation shall not give rise to the payment of damages or interest for any reason whatsoever. If this occurs repeatedly, excessively, and without valid justification, the photographer reserves the right to refuse future service to the client. In case of unfavorable weather conditions, the photographer shall not be held responsible for the non-execution or partial execution of the service originally planned when the shoot is to be conducted outdoors or if access to the studio or the client's home proves impossible.
4. Photo Session Process
The client agrees to be on time for the appointment scheduled for the session. Beyond a 15-minute delay without a valid justification (traffic is not considered a valid reason), the photographer reserves the right to reschedule the service or apply a surcharge to the session price. Any delay will be deducted from the initially planned timeframe so as not to penalize any subsequent clients, who should not have to suffer the delay. The client is authorized to film or take photos of the "backstage" if they wish; however, the photographer must have a right of review and give her mandatory authorization before any distribution by any means whatsoever. It is permitted to be accompanied; however, the third party will be asked not to interfere with the photographer's work. It is also possible to bring inspirations or various objects if the client's request is specific. Finally, the client must complete and sign two copies of an image rights authorization (if the client is a minor, authorization must be requested in advance so that the legal guardian can complete and sign it if they are absent on the day of the photo session).
5. Post-production
Editing and post-production are an integral part of the photographer's work, style, and artistic universe, just as the photo shoot itself is unique to her. The photographer is the sole judge of the final post-processing applied to all images. However, a discussion will take place with the client beforehand regarding specific requests (such as concealing certain details). For photo book orders, the client may send layout examples they like for the photographer's inspiration.
No raw files (RAW) will be delivered to the client, nor can they be demanded. Digital files are delivered via email through WeTransfer in JPEG format. The photographer agrees to keep the digital files for one year after the date of the shoot, except in the event of a disaster beyond her control; beyond this period, the backup of the files is no longer guaranteed, and they may be destroyed.
6. Technical Issues and/or Accident(s)
In the event of a technical problem with the photographic equipment or any accident during the service preventing the photographer from delivering the requested work, the full amount paid will be refunded, without giving rise to the payment of any damages or interest for any reason whatsoever. The client may also agree to reschedule the session to a later date. In case of loss or damage to the photos before their delivery, such that the initial service can no longer be fully completed, the client may claim a partial or total refund for the service.
7. Tirages
The total amount for the products must be paid in full on the day of the order. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for these products, as they are considered clearly personalized. Payment shall be made by cash or bank transfer / Paypal, and delivery will be made by post* or in person. The delivery time for the order is between 15 and 20 days from the date of payment, except in exceptional cases (unforeseen problems with the supplier). Orders for prints can be placed via email or Instagram. The request must include the following information: the names of the desired photos (if not from a shoot), the desired size and paper type**, and the postal address.
* Additional delays caused by the postal service will not be taken into account by the photographer, as they are beyond her control.
** In case of indecision, the photographer remains available to help the client make the right choice. Available sizes and paper types are specified in the "Prints" highlight story on the Instagram account.
8. Intellectual Property
The photographs produced are "works of the mind" protected by the French Intellectual Property Code (Art. L111-1 et seq.). Even after the files have been delivered, the photographer remains the sole owner of the intellectual property rights. Only the client's image rights are inalienable. Any commercial use must be specified at the time of booking.
Infringement: Any unauthorized use (distribution, reproduction) constitutes a crime of counterfeiting under Article L335-2 of the Intellectual Property Code (CPI), punishable by up to 3 years' imprisonment and a €300,000 fine.
Mandatory Credit: For any public distribution, the client must credit the photographer: "© Chloé Oczkowski" and tag/identify her via the corresponding account. Failure to comply with this requirement may result in a flat fee billing of €40 per image distributed.
Private Use: When the client purchases high-resolution digital files, they are authorized to save them on any media of their choice for conservation purposes only, and strictly for their personal and private use.
9. Data Protection (GDPR)
In accordance with the General Data Protection Regulation (GDPR) and the French "Informatique et Libertés" law, the information collected (name, email, image) is necessary for processing your order. You have the right to access, rectify, and delete your data by contacting the photographer directly at the address mentioned in Article 10.
10. Governing Law and Language
These terms and conditions are governed by French law. They are drafted in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
